With the issue of #MaritalRape getting centre stage in many debates on tv channels and print media, the big questions are still left unanswered in this issue or otherwise #Rape in general.. >> If the definition of rape is sex by force and without consent then why it is been considered always as a crime which can be committed by a man with woman not otherwise or vice-versa? >> Why in all law-books the punishment is only defined under all the legal sections for the act of penetration by force but never for the act of forced to penetrate? >> Why the right of giving consent in sexual relationships is only been entrusted upon a specific gender (women) while other gender (men) is left with no option but considered as have given a consent in all situations inherently perceived? >> What is the legal protection available with a man when he is been raped by a woman inside or outside the marriage with the definition of rape remain same and specific i.e. sex without consent which is rather can be equally applied in case of all the genders without any discrimination before the law? >> With the definition of consent been left so ambiguous and uncertain, how it is to be proved that charge of rape is not a rape but in actual a consent given first but been foul cried rape later due to one another reasons or malafide intentions, with also a clear procedure been defined that how and by which means the consent is to be recorded between the two consenting individuals of proper age when entering in a sexual relationship in that charged moment of time? #Kanwal

COMPLAINT to CTU Chandigarh for No Bus Service on a particular route for more than 1 hour 21.04.2015 To Director Transport CTU Chandigarh Sir / Madam I am Kawaldeep Singh, A Ph.D. research scholar and RTI Activist from Patiala. I am in city of Chandigarh today, i.e. 21.04.2015 for some urgent work, for which I had to travel from ISBT 43 to Bassi Theater Sector 54 Mohali. I got issued a daily pass no. A 0022949, as attached, by payment of ₹ 30/- at 9:45 am at counter no. 6 and since then I was waiting for the bus, however till11:04 am I haven't seen any bus for same route though when I can clearly check the frequency of the bus on same route is supposed to be of every 30 minutes as per inscribed time over the counter. This extremely poor non-service on the part of CTU has clearly hampered my work. I hereby ask for following relief, due to my loss: 1. Total refund of the payment of ₹ 30 for pass. 2. A Compensation of ₹ 500/- due to my loss of work on part of CTU. Kindly revert within 10 days of this email with resolution, failure on which I may proceed under the applicable recourse as per the law of land. To Chairman Punjab State Human Rights Commission Chandigarh Subject: Inquiring the matter and Directing State DGP to register FIR u/s 307 IPC and other sections of law as applicable against the radical fanatics spreading terror, assaulting people and taking law and order in their hands, based upon the news report published in Ajit Jalandhar on 28.04.2015 Sir I would like to bring in your notice a very serious matter of spreading terror, assaulting people and taking law and order in their hands by certain radical and fanatic groups active all over the state of Punjab as per the news report published in newspaper Ajit Jalandhar on 28 april 2015, kindly refer to the attached scanned copy of the news cutting with this email. It is a matter in which certain person(s) were transporting cattles and all of sudden few people from an organisation driving a scorpio stopped the truck, dragged the driver outside, had beaten him mercilessly, broken his knees and ankles and set the truck on fire after forcefully dragging all the cattles out. The driver was assaulted so mercilessly that he could had died in all these turns of this event and the most shocking in this incident is the presence of a police person at the place, as reported, but he failed to act or prevent this event of crime. So thus it establishes that such people who are committing this crime have the blessings of police and local politicians, therefore, any enquiry assigned to ground level police stations would only be an eyewash and would merely act as attempt to save the guilty. Further seriousness of the situations as per the news report can be analysed from the fact that such incidents are claimed to be happening all over the state. If this is true then it is completely a failure of law and order machinery in the state and leading us to the jungle raj, which is very serious matter. So thus as a responsible citizen I hereby file a complaint in State Human Rights Commission to take cognizance, initiate an enquiry in this matter under its own supervision and to direct the State DGP to register an FIR u/s 307 IPC and other sections of law as applicable against the radical fanatics spreading terror, assaulting people to a level to attempt of murder and taking law and order in their hands and get this matter enquired by some high level official with undisputable integrity and commitment. Kindly take this matter on urgent basis considering the gravity of the situation involved in this matter and pass a written order in this regard and keep the matter under the supervision of Punjab State Human Rights Commission until its final conclusion. While condemning the beating incident of old and poor priests by the members of the self-pronounced Satkar Committee in all the strong words and supporting the proper legal action against them as per the law of the land, I though feel that the booking of the very members of Satikar Committee u/s 307 of IPC is totally uncalled for, because the gravity of their crimes does not qualify at all under the requirements of this very section for attempt to murder, as it is very clear from all the footages available of the incidents that nobody had actually attempted any murder anywhere in these incidents. A strict but just Police action though I feel is very necessary to curb such menace alike, but any harassment on the name of law and order should have to be condemned too. The ones who had taken the law in their hands should have to be booked accordingly, but it is also completely unnecessary to book them under such harsh sections of law-books and the crimes under which otherwise nothing has ever happened, and thus in a manner create a pompous show of police raj and further violations of human rights, all in all. Every law enforcement should always remember that the fundamental principle and basic purpose of any justice system is the reformation not the punishment at all, and so thus is implemented in spirit and actions. #Kanwal

Its hard but courts have to work on law books, right or wrong that is different issue, and there could be no relief just on basis of emotions or public opinion there. Courts can give wrong decisions but they couldn't go against the written law, if there is no provision as such in written law, then I am sorry but there is no option for them, irrespective of you being right or wrong. That last video of the hymn-singer is rather an evidence of fact, idiots, that you have no arrangements to handle a medical emergency which could emerge out anytime and anywhere, all of a sudden, even at your religious places, than being a showpiece of some kind of spiritual salvation; so that so, when a man undergoes through the critical condition of life and death all you idiots rather than arranging on the spot first aid are more concerned about your hymn singing or some kind of synthetic personal spiritual experiences or some customs of religious place of yours by making the life of a man only secondary in that situation, and for your kind of information a cardiac arrest shows certain signs beforehand but all those may had been ignored and the man might put on singing performance, no denial to his own ignorance or carelessness in the matter. And for your knowledge, showing an extreme act of conviction and courage and dying at your will for a larger cause or being killed in a battlefield while fighting under your own choice is totally different from dying just because of the lack of some medical help. #Kanwal

With the news coming out of two fake encounters by police in India one of 5 chained prisoners and other of 20 labourers, and all the media is reporting it very strongly and the opinions are coming from inside the country and world over against such practices which are nothing but a murder of democracy and rule of law and at total violation of human rights, I can recall a self-confession by a police officer in private to me, which he did out of some provocation by me, in which he accepted doing at least 20 such fake encounters during the period of so termed militancy in Punjab, and in that heat of moment, the person was ashamed of what he did, now it is another matter that he was acquitted from all the charges through the Supreme Court.

To Ex-Justice @Markanday Katzu Sir You're neither the first one who is deprived of justice without being given any opportunity to be heard before nor seeming the would be last; millions of citizens are facing this, specially when the Petitions under article 136 are decided by not even giving the petitioner a chance to speak in the very Supreme Court of yours in which you were the incumbent once, by same fellow judges of yours who consider themselves nothing less than God, without even giving a miniscule of consideration to all the pain and agony petitioners had gone through and what all hardships one had faced for reaching there. It is sad that you only realized this post-retirement, while your successers still not, or they have specifically chosen to realize this only after retirement like you. Sir, when there is equality before law been fundamental right, then the equality should have to be there in facing injustice too, whether it is a humble citizen or an ex-Milord ! I wish if you could had such realization in pre-retirement period, then atleast some of the common citizens could had the light of justice in their lives !! .

तथाकथित सामाजिक आंदोलन से निकली और सभी वर्गों को साथ ले कर नये बदलाव का दंभ भरने वाली #आप भी अब बाकी मुख्यधारा वाली पार्टियों जैसे ही केवल ब्राह्मण-बनिया पार्टी भर ही रह गई है, जिस से सर्व-समाज के कलयाण में कोई भी योगदान कर सकने अपेक्षा भर भी करना अब तो मूढ़ता ही होगी | #कंवल
