Order of the First Appellate Authority, Supreme Court of India in the matter of First Appeal u/s 19 of the RTI Act, 2005 filed with it for the case of an RTI Application originally filed with the Central Public Information Officer, Department of Justice, Ministry of Law and Justice, Government of India vide registration no. JUSTC/R/2015/60289 dated 26.03.2015 in regard to the records available for the Transfer Petitions filed in the Supreme Court of India in the cases related to the matrimonial disputes, which was physically transferred to the concerned Central Public Information Officer, Supreme Court of India, dated 31.03.2015, due to the default on the part of the respondent CPIO after transfer for not providing the information within the stipulated time as described in the Act. The main points in the order of First Appellate are: 1. On verification of records it is seen that no such letter has been received by the Additional Registrar/ CPIO. Therefore in a manner it establishes that Central Public Information Officer, Department of Justice, Ministry of Law and Justice, Government of India, the original addressee in the matter, gave a malafide and wrongful reply in regard to the transfer of this RTI Application about its transfer to the Central Public Information Officer, Supreme Court of India. 2. In the interest of justice the copy of the Application dated 26.03.2015 attached to the appeal is forwarded to the Additional Registrar/CPIO for necessary action at his end within the prescribed period to be reckoned and calculated from the date of receipt of this order.
