Kanwalosophy: Second Appeal to State Information Commission Punjab against the order of First Appellate Authority, O/o Principal Secretary, Department of Finance - Government of Punjab, in the matter of denial of information by the concerned Public Information Officer in regard to an RTI application asking the information related to the details of ministry / department wise funds allocated and spent as budgetary, non-budgetary or the provisions otherwise for the purpose of advertisements in various modes of media by the government of Punjab along with the category and name-wise details of the media organizations concerned. In the "claimed order", though unlawful, of First Appellate Authority it has malafidely and willfully been denied to provide information in the reply to abovesaid first appeal. It is illegal on the ground that it has been provided under the signature of same Sh. Kashmira Singh, Public Information Officer who replied to the RTI Application itself, a clear violation of section 19(1) which madates that Appellate Authority has to be senior in rank from the PIO. Moreover, the Appellate Authority completely failed to pass any speaking and reasoned order as per the reliefs sought in the abovesaid First Appeal. Not only this but the officer concerned gave totally wrongful assertions in this reply as under: (i) The information related to the department has already been provided to the appellant a letter dated 08.07.2015 from the PIO, which is completely wrongful and also the matter of record in this case. (ii) Not only this, but to further harass the appellant he has unlawfully asked the appellant to personally appear before him to get the clarity of the status of rules / directions of this department, in regard to same he has no authority and powers as per any of the provisions of the RTI Act, 2005. 29.07.2015 Page 04 of 04
